UK Contractors: How will IR35 reforms affect Contractors and Companies?

I am an independent SAS consultant and have been working through my own company, Holland Numerics Limited, since 1992. In the UK the vast majority of IT contractors use Limited companies when working for other companies, which protect both the contractors and their clients. Contractors also benefit from the clients paying their company, and then the company paying them, so there can be tax and National Insurance savings. This has been seen by Labour and Conservative governments as tax avoidance, and the Labour government introduced IR35 legislation in 2000 to restrict these benefits for contractors who are also company directors when they were only working for a single client, labelled as “deemed employees”. This forced contractors to pay the same tax and National Insurance as permanent employees, but without any employee benefits.

It should be noted here that permanent employees receive a number of benefits as part of their employment, but contractors have to pay for these themselves:

  • payroll processing, including tax and National Insurance payments
  • pension payments
  • employer National Insurance contributions
  • business-related insurance
  • travel expenses
  • conference attendance fees
  • equipment purchase
  • office facilities

Until now the responsibility of stating whether a contractor is inside or outside IR35 and paying the correct tax and National Insurance payments has been with the contractor’s company, but the reforms move these responsibilities to the client (determining IR35 status) and agency (paying the correct tax and National Insurance payments). Some companies have already decided to set the IR35 status of all of their contractors to inside, including Lloyds Bank, Barclays and GlaxoSmithKline, making them “deemed employees”. There is now a question about what can contractors do to stay outside of IR35, and then persuade their clients not to state that they are inside. I can’t claim to be an expert on this subject, but I can suggest some organisations who are much better qualified to answer this question. SAS Lifetime Achievement Award

My university degrees were in Chemistry, but when I tried to find my first job there were none in Chemistry, so, as I’d developed an interest in computing, I decided to move into Information Technology instead. I have never really considered my jobs to be work, even to the present day, but more like a paid hobby.

I first encountered SAS software (version 79.5) in 1981 while working as a mainframe systems programmer at the University of London Computer Centre. Not long after that I was the SAS Representative at Prudential Assurance in London installing SAS on their mainframes, and making myself known to SAS UK by asking their Technical Support question after question about a wide range of SAS features.

In September 1992, 25 years ago, I went freelance, formed my own SAS software consultancy, Holland Numerics Limited, and started work on the first of two SAS contracts in Belgium. Since then I have also worked with, and provided training for, SAS-using companies in the UK, Netherlands, Germany, France, Switzerland, Spain and the USA. As a permanent employee I was never allowed to attend conferences, so I’ve made the most of my freelance status to attend at least one conference every year since 1993, and have presented SAS-related papers at many international conferences since 1995 too. My first paper was presented at SeUGI in Stockholm.

I discovered social media in 2005 when I registered on LinkedIn, but my social media activities really took off in 2008 when I joined Squidoo, and then Twitter, to advertise my first SAS-related book, “Saving Time and Money Using SAS” published by SAS Press. Since then I’ve become active on a number of sites answering SAS-related questions and advertising more of my books. The web sites have included LinkedIn Groups, SASProfessionals.Net, sasCommunity.org, Google+ Communities, SAS Customer Support Communities, BeBee, and now WordPress on this site.

So why do I still not believe that I’ve won a SAS award? I was sent an email the previous week asking if I wanted to attend the Awards Dinner at SAS Forum UK, as I’d been nominated for an award, but not that I’d actually won one, or even which award it was. Everyone from SAS UK I’d met from when I arrived at the conference in Birmingham had been very welcoming, but that certainly wasn’t unusual. Even the description of me before my name was finally revealed referred to me presenting on Analytics at conferences didn’t seem to fit either (until someone later explained to me that SAS staff generally include graphics in Analytics!). Even stepping onto the stage to receive my award felt like I was part of an elaborate hoax, but the warmth of Laurie Miles and Charles Senabulya soon removed that thought from my mind, and I felt extremely honoured to be there and receiving the SAS Lifetime Achievement Award from friends I admired.

Back at my seat I sent a message to my wife Angela to tell her about it. She replied: “Does that mean you can retire as they don’t expect you to do anything else”. Remember at the top of this post I called my job a paid hobby. Some people retire so they’ll have more time to spend on their hobbies, but I’m not sure it is possible to retire from a hobby!!

 

 

Have You Forgotten Your Password?

The registration page on my blog site encourages new members to create at least a “Medium” strength password. This is good for the security of their personal information, but not so good if they follow the general security advice by not writing that password on a sticky note and attaching it to their computer screen or tablet. Unfortunately, no-one has a perfect memory, and the Password Reset functionality in WordPress is dependent on a number of different factors too, including the site’s email setup, the email address used by the site, the rules of the email server used by the site, and the rules used by the member’s email server. Actually it is quite astonishing that it works at all, which is why I’d like to make you all aware of a more reliable method, at least as a last resort, in case you ever forget your password:

  1. Go to my blog site at http://blog.hollandnumerics.org.uk and click on the [Password Reset] link in the menu (under [Member Login]).
  2. Type in the email address you used when you registered on my blog site, or the most recently email address you’ve registered since joining, and click the [RESET PASSWORD] button.
  3. You should receive an email containing a link to the password reset page within a few minutes, and using that link should allow you to change your password to something you can remember.
  4. If you don’t receive an email within a few minutes, or the link in the email doesn’t seem to work, then you can contact the site administrator (that’s me!) by using the [Contact us] link, remembering to include the same email address you used on the site.
  5. I will send you back a freshly generated and fiendishly strong password by email with instructions to use it immediately to log in.
  6. Once you have logged in use the [Edit Profile] link in the menu (under [Member Login]) to update your password to something you can remember.

Note that I can check whether it really is you trying to update your password, and it will only be sent back to your registered email address. Note also that I’m based in the UK, so don’t expect a lightning fast response when it is 3am GMT. In return I will try to send you your new password at a reasonable time of the day for you too.

Please note that if you just want to change your password, but can still log in, starting at step #6 will work just fine for you!
